Terms of Use

These Terms govern access to PAINTBALL BST. By accepting them, you agree to this version and acknowledge the accompanying Privacy Notice.

1. Eligibility and accounts

You must be at least 16 years old to use the marketplace. You must provide accurate account information, keep your credentials secure, and are responsible for activity under your account. Accounts may not be transferred or used to evade a suspension.

2. Marketplace role — no fees, no guaranteed sale

PAINTBALL BST provides listing, direct messaging, offer, and discussion tools that let members find each other and discuss a possible sale. We are not the buyer, seller, payment processor, shipping carrier, escrow agent, auctioneer, or guarantor of any transaction, and we are not a party to any agreement members reach with each other.

PAINTBALL BST does not charge, collect, or receive any listing fee, commission, percentage of sale price, or other consideration tied to a transaction between members. We do not guarantee that any listing will sell, that any buyer or seller will follow through, or that any member is who they claim to be. Members are solely responsible for negotiating, inspecting items, agreeing on price, payment, and delivery terms, completing the transaction, and complying with applicable law.

3. Permitted items — paintball only, firearms prohibited

This marketplace exists solely for paintball markers, loaders, tanks, protective gear, apparel, parts, and other bona fide paintball-related accessories and goods. Listings, offers, messages, and discussion content must be limited to those categories.

Firearms, firearm receivers or frames, firearm ammunition, firearm-specific parts or accessories, and any item marketed or convertible for use as a firearm are strictly prohibited, with no exceptions. This prohibition applies even where an item superficially resembles paintball equipment. We will remove prohibited listings and content on discovery and may suspend or terminate the accounts of members who post them, without notice.

4. Compressed gas, tanks, and shipping

Compressed air (HPA) and CO2 tanks are pressure vessels, and their transport is regulated. If you ship one, you are responsible for meeting your carrier’s rules for pressurized vessels — including degassing and removing the valve where the carrier requires it — and for declaring and packaging the shipment correctly.

Do not list or ship a tank whose hydrostatic test has expired, and state the hydro date in the listing so a buyer can check it. Filling, servicing, inspecting, and transporting tanks are the responsibility of the members involved, not PAINTBALL BST.

5. Listings and conduct

Listings and messages must be truthful, lawful, and limited to permitted paintball equipment as described above. Do not post counterfeit, stolen, unsafe, recalled, or otherwise prohibited items; impersonate others; manipulate marketplace limits; harass members; scrape the service; upload malware; or misuse personal information. Follow applicable age, transport, shipping, and equipment laws in your location.

6. Your content

You retain ownership of content you submit. You grant PAINTBALL BST a non-exclusive, worldwide, royalty-free license to host, reproduce, resize, display, and distribute that content only as reasonably needed to operate, secure, and promote the marketplace.

That license lasts while the content is published on the marketplace and ends when the content is removed, except for copies kept in routine backups and in the moderation and dispute records described in Section 8.

7. Feedback

If you send us suggestions, feature ideas, bug reports, or other feedback, we may use it without restriction, credit, or payment, and without any obligation to you. Do not send us anything you consider confidential.

8. Moderation and availability

We may review reports and hide or remove listings, comments, or accounts that violate these Terms or create risk, including any listing that violates Section 3. Listings may expire under current marketplace settings. Service availability and particular features are not guaranteed.

9. Termination

We may suspend or terminate an account that violates these Terms, that creates risk for other members, or that is used to evade an earlier suspension. Active listings on a terminated account are removed from the marketplace. Discussion content may remain in place where other members’ replies depend on it, with the account removed from it.

You may close your own account at any time — see Data deletion for how to request it and what is removed. Sections 2, 6, 7, 12, 13, and 15 survive termination, along with the moderation, dispute, and audit records described in the Privacy Notice.

If you believe content on the marketplace infringes your copyright, send a notice to our designated agent at support@paintballbst.com including all of the following:

  • your physical or electronic signature;
  • identification of the copyrighted work you claim was infringed;
  • identification of the material claimed to be infringing, with the link or a description precise enough for us to locate it;
  • your name, address, telephone number, and email address;
  • a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law;
  • a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

On a valid notice we remove or disable the material and notify the member who posted it. That member may send a counter-notice to the same address containing their signature, identification of the removed material and where it appeared, a statement under penalty of perjury that it was removed through mistake or misidentification, and their name, address, telephone number, and consent to the jurisdiction of the federal court for their district. We may restore the material after the period allowed by law unless the complaining party notifies us that it has filed an action. Accounts that repeatedly infringe are terminated.

11. Third-party links and services

The marketplace links to pages we do not operate, and members arrange payment, shipping, and meetups through services we do not control. We do not endorse or take responsibility for third-party content, terms, fees, availability, or handling of your information, including any payment method you agree to with another member. Read their terms; a dispute with a third party is between you and them.

12. Risk, disclaimers, and liability

Assumption of risk. Any transaction, communication, or in-person meetup arranged with another member is solely between those members and undertaken at their own risk. Transactions with other members carry fraud, misrepresentation, item-condition, non-payment, non-delivery, shipping-loss, and personal-safety risks that PAINTBALL BST does not investigate, insure, or assume.

Release. To the fullest extent permitted by law, members release PAINTBALL BST from claims, damages, and demands arising out of disputes with other members or out of listings, transactions, or meetups facilitated through the service.

No warranty. The service and all content on it are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted or error-free operation, to the extent permitted by law.

Limitation of liability. To the fullest extent permitted by law, PAINTBALL BST and its officers, employees, and agents are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or losses arising from a transaction, item, or interaction between members, even if advised of the possibility. Aggregate liability for any claim relating to the service is limited to the greater of the amount you paid PAINTBALL BST in the twelve months before the claim (expected to be zero, given Section 2) or USD $100.

Indemnity. You agree to defend and indemnify PAINTBALL BST against claims, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the service, your listings or content, your violation of these Terms, or your transactions or disputes with other members.

13. Governing law and disputes

These Terms are governed by the laws of the State of Texas and applicable United States federal law, without regard to Texas conflict-of-laws rules. Any dispute arising out of these Terms or the service must be brought exclusively in the state or federal courts located in the State of Texas, and you and PAINTBALL BST each consent to personal jurisdiction and venue in those courts.

Either party may seek injunctive relief where appropriate. Nothing here removes your right to bring a qualifying claim in small-claims court, or deprives you of a mandatory consumer protection that cannot be waived under the law of the place you live.

14. Electronic communications

By using the marketplace you agree to receive notices from us electronically: in the app, by email to the address on your account, or by publishing a new version of these Terms. Electronic notices satisfy any requirement that a communication be in writing.

15. General provisions

If a provision of these Terms is held unenforceable, it is limited or severed to the minimum extent necessary and the rest remains in force. These Terms and the Privacy Notice are the entire agreement between you and PAINTBALL BST about the service and replace earlier versions. Not enforcing a provision is not a waiver of it. You may not assign these Terms or your account; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is responsible for a failure to perform caused by events outside its reasonable control. These Terms create no third-party beneficiaries.

16. Changes and contact

Material changes will use a new version and may require acceptance before further marketplace use. PAINTBALL BST is the operator of this marketplace.
